Abstract
التشريع في مجال الصفقات العمومية وتفويضات المرفق العام من أهم التشريعات
التي نظمت محور اإلنفاق العام للدولة ، لذلك تميزت بترسانة قانونية كفلها إياها المشرع
وتلبية الحاجيات ، حيث منح المصلحة المتعاقدة سلطة الجزائري للحفاظ على المال العام
االختيار بين طرق اإلبرام وفق ما تقتضيه الظروف إما عن طريق طلب العروض كأصل
عام أو التراضي بنوعيه ، غير انه خروجا عن القاعدة العامة واستثناءا وفي ظل عدم
وجود آلية لتوقع الظروف االستثنائية والكوارث التكنولوجية والطبيعية وانتشار األوبئة
كجائحة كوفيد 19 تفضل دائما المصالح المتعاقدة اللجوء الى الطريق السهل والمختصر
لتفادي طول اإلجراءات الشكلية وهذا عن طريق إبرام الصفقات العمومية وفقا لما جاءت
به المادة 12 من المرسوم الرئاسي 247-15 في الجزئية المتمحورة حول االستعجال
الملح وفق إجراءات خاصة رغم ما يحوم حولها من شبهات وما تمليه من تناقضات في
ظل وجود الفساد وتغليب المصلحة الشخصية على الصالح العام .

Abstract :
Legislation in the field of public transactions and public utility
mandates is one of the most important legislations that regulated
the axis of public spending of the state, so it was characterized by
a legal arsenal guaranteed by the Algerian legislator to preserve
public money and meet the needs, as the contracting interest was
granted the authority to choose between the methods of conclusion
according to what the circumstances required, either by requesting
Offers as a general principle or mutual consent of both kinds,
however, it is a departure from the general rule and an exception
and in the absence of a mechanism to anticipate exceptional
circumstances, technological and natural disasters and the spread
of epidemics such as the Covid 19 pandemic. Public transactions,
according to what was stated in Article 12 of Presidential Decree
15-247 in the part centered on urgent urgency according to
special procedures, despite the suspicions surrounding them and
the dictated contradictions in light of the existence of corruption
and the primacy of personal interest over the public interest.
