Abstract
شهدت مختلف التشريعات العربية وعلى غرارهم التشريع الجزائري بعد ثورات الربيع العربي جملة من الإصلاحات طالت منظومتها القانونية ومست جملة من الحريات ، والتي يأتي على رأسها الإعلام لما كان له من أهمية بارزة ودور فعال في هذه الثورات ، فلإعلام في الجزائر مر بالكثير من المحطات كان آخرها قانون الإعلام 12-05 الذي فتح القطاع السمعي البصري على القطاع الخاص بعد أن كان محتكرا من قبل الدولة ، كما استحدث المشرع سلطتي ضبط الصحافة المكتوبة والسمعي البصري رغبة منه في إرساء ضوابط لممارسة حرية الإعلام وضبط العلاقة بين الحرية والنظام العام وأمن الدولة . و لذلك فقد أردنا من خلال هذه الدراسة أن نلقي الضوء على حرية الممارسة الإعلامية في الجزائر من خلال القوانين التي تنظم القطاع والتي يراها البعض تكريسا لحرية الإعلام فيما يراها آخرون أنها تقييد وتضييق على هذه الحرية .
Les diverses lois arabes dont la législation algérienne ont entrepris après les révolutions du printemps arabe , un certain nombre de réformes affectant la majeure partie du système juridique qui a touché un certain nombre de libertés et en particulier les médias a cause de son importance exceptionnelle et son rôle efficace dans ces révolutions , en Algérie les médias sont passés par différentes étapes , plus récemment la loi 12-05 qui ouvre le secteur audiovisuel au secteur privé après le monopole de l'Etat , il a aussi crée deux autorités de régulation, l'une pour la presse écrite, l'autre pour l'audiovisuel Désireux mettre en place des contrôles entre la liberté et l'ordre public et à la sécurité de l'État. à travers cette étude que Nous voudrions mettre l'accent sur l'exercice de la liberté des médias en Algérie a travers les différents lois qui règlent cet secteur , que certains voient comme une confirmation de la liberté des médias, tandis que d'autres voient qu'il a limité et étroit sur cette liberté.
The various Arab legislations followed by the Algerian legislation after the revolution of the Arab Spring witnessed a number of reforms that effected most of its legal system and a number of freedom , especially the media , because of its prominent importance and affective role in these revolution .The media in Algeria passed through many stations , the latest of which was the Media Law 12-05 , which opened the audiovisual sector to the private sector after it was monopolized by the state. The legislator was also Establishes two independent regulatory authorities, one for print media and the other for audio-visual media Desiring to Instituting more effective controls between freedom , the public order and the security of the State And through these study I want to highlight The freedom of the media practice in Algeria through the laws that regulate the private sector, which some see as a confirmation of the freedom of the media, while others see it restricted and narrow on this freedom .
