Abstract
We have tried through this study to understand the provisions of illegal speculative crime and to study the mechanisms of the Algerian legislator to deter this crime. Especially after the increase in its spread recently, in which economic agents and traders have taken advantage of the covid-19 epidemic crisis in their favour, and this is reflected in their illegal practices that cause market disruption and benefit from Among these emergent situations to achieve personal profits, such as the monopolization of goods and the dissemination of false information about their rarity, then putting them in the market at high prices, and this has negatively affected the market system and also affected the consumer, because this crime affects the basic and necessary materials that the citizen needs. The legal texts that aim to fight against this crime, as well as the mechanisms taken by the State to curb this crime and maintain the market system and prices are no longer enough to deter the perpetrators, which is why the state has promulgated law 21-15 on the fight against illegal speculation to suppress this offense and deter its perpetrators. This law was abolished to implement the articles that stipulated this crime in the Penal Code and was accompanied by severe penalties and new mechanisms to deter and prevent it.
