Abstract:
Our thesis deals with the most important topic in the Criminal Law,
particularly in terms of criminal evidence under the title "criminal
evidence by means of sound and image" because the latter affects the
individuals rights and freedoms, in particular the right to sanctity of
private life as well as the right to privacy and the right of the human in
his image. Indeed, the continuous scientific and technological
development at a rapid pace has led to the emergence of modern means
of committing the crime. This prompted the legislator to adopt means
electronic monitoring methods to reach the truth and arrest the
perpetrators of crimes and more particularly sound or audio recording,
the taking of fixed or animated pictures or video types which are used to
help in the discovery of crimes and according to the procedures,
guarantees and legal limits and which are often always under the
supervision and control of judicial authorities. Indeed, the legislator took
care to protect the right in the intimacy of the public life of the individuals
of society and he went further by recognizing the possibility of recording
private conversations pictures, whether in a public or private place
without the consent of the person concerned in the cases provided for by
law and left the assessment in the finding to the to the discretionary power
of the Algerian judge according to his personal conviction.
