Abstract
تطرقنا في هذه المذكرة لدراسة تقنية تفويض المرفق العام كطريقة حديثة لضمان استمرارية سير المرافق العامة كونها الحل الأمثل لأن أسلوب التفويض ما هو إلا انتقال الإدارة من التسيير المباشر إلى الإدارة غير المباشرة وهذه فكرة ليست بجديدة في التشريع الجزائري و إنما لم يتم التواصل إلى اعتماد سياسة شاملة ومنظمة لهذه العقود الإدارية في إطار قانوني إلا أن تبنت الدولة هذا الأسلوب و صدر المرسوم الرئاسي 15-247 الذي تضمن تنظيم عقود تفويض المرفق العام لأول مرة منذ الاستقلال ثم تلاه المرسوم التنفيذي 18-199 المتعلق بتفويضات المرفق العام
