Abstract
تتناول هذه الدراسة القضاء في أيالة الجزائر خلال العهد العثماني (1518-1830) وتكشف عن دور النظام القضائي في تشكيل المجتمع الجزائري. أظهرت النتائج أن القضاء في الجزائر كان متنوعًا مذهبيًا، حيث ساهم وجود القضاء الحنفي والمالكي في المدن الكبرى والقضاء في الأرياف في تنظيم الحياة العامة وضبط النزاعات. كما كشفت الدراسة عن تأثير قوي للسلطة السياسية على القضاء، مما أثر على استقلاليته وأدى إلى ارتباط القضاء بالعائلات المؤثرة في المجتمع.
وأوضحت الدراسة أن هذا النظام القضائي كان له تأثير مباشر على الحياة الاجتماعية والثقافية والسياسية، حيث ساهم في تنظيم الحياة اليومية وأثر على العلاقات بين الفئات المختلفة في المجتمع. في الختام، أكدت الدراسة أن القضاء العثماني كان له دور محوري في تشكيل الهوية الجزائرية خلال فترة الحكم العثماني، مما ساهم في استمرارية بعض القيم الاجتماعية والسياسية حتى بعد نهاية العهد العثماني
This study examines the judiciary in the Regency of Algiers during the Ottoman period (1518-1830) and reveals the role of the judicial system in shaping Algerian society. The findings show that the judiciary in Algeria was diverse in terms of legal schools, with the presence of both Hanafi and Maliki courts in major cities and rural areas playing a crucial role in organizing public life and resolving disputes. The study also reveals the strong influence of political authority on the judiciary, which affected its independence and led to the judiciary being closely linked to influential families in society.
The study demonstrates that this judicial system had a direct impact on social, cultural, and political life, contributing to the organization of daily life and affecting relationships among different social groups. In conclusion, the study affirms that the Ottoman judiciary played a pivotal role in shaping Algerian identity during the Ottoman rule, which contributed to the persistence of certain social and political values even after the end of the Ottoman era.
