Abstract

أولى المشرع ملخص البحث: Abstract: The Algerian legislature has shown great interest in the welfare of children through its laws that protect them, such as the Penal Code. It has also provided special protection for them through Law No. 15/12, which embodies the provisions of the Convention on the Rights of the Child ratified by Algeria. Considering that schoolchildren constitute the nucleus of the nation's future, progress, and growth, the legislature has granted them the care and protection they deserve. They are criminally protected in various legal situations, whether they are victims, offenders, or at risk, through a set of laws, decisions, and guidelines that cater to this category of children. Especially noteworthy is the directive law on education, No. 08/04, and Decision No. 65/18, which specifies the organization and functioning of the educational community. From this perspective, this research is divided into two chapters to shed light on the effectiveness of this protection within the legal framework established by the legislature to safeguard children. The focus was placed on implementing these mechanisms in practice to align with the multitude of laws and evolving forms of crimes occurring in schools.
