| dc.description.abstract | تعالج هذه المذكرة جرائم الإخلال بالالتزامات الأسرية في التشريع الجزائري، التي تعتبر من الجرائم الواقعة على نظام الأسرة كأفراد وككيان، والناتجة عن إهمال أحد الزوجين لأسرته إهمالا ماديا أو معنويا، وقد خص المشرع الجزائري حماية خاصة للأسرة نظرا لأهميتها في بناء المجتمع والدولة، لذا فقد جرم عدة أفعال يأتيها أحد الزوجين فيها إخلال بالتزاماتهما تجاه الأسرة ونص عليها في قانون العقوبات. وخلصت الدراسة إلى إبراز أهم الثغرات التي أغفلها المشرع الجزائري وأدرجنا أهم الحلول التي يمكن اعتمادها لسد هاته الثغرات. وكإجابة على الإشكالية توصلنا إلى أن المشرع الجزائري لم يوفق في ردع جرائم الاخلال بالالتزامات الأسرية نظرا للكم الهائل من القضايا المطروحة أمام المحاكم والتي هي في تزايد عام بعد عام. Abstract This memorandum deals with the crimes of breaching family obligations in the Algerian legislation, which are considered among the crimes of the family system as individuals and as an entity, and resulting from the neglect of one of the spouses of his family by material or moral neglect, and the Algerian legislator has allocated special protection for the family due to its importance in building society and the state Therefore, he has committed several acts committed by one of the spouses in breaching their obligations towards the family as stipulated in the Penal Code. The study concluded by highlighting the most important gaps that the Algerian legislator has overlooked, and we have listed the most important solutions that can be adopted to fill these gaps. As an answer to the problem, we concluded that the Algerian legislator has not succeeded in deterring the crimes of breaching family obligations due to the huge number of cases before the courts, which are increasing year after year | en_US |
