Abstract
تناولت هذه الدراسة نظریة أعمال السیادة دراسة مقارنة وهي من الموضوعات القانون
الإداري والدستوري معا، تمثلت مشكلة الدراسة في مجموعة من التساؤلات منها ماهیة أعمال
السیادة؟ وماهي معاییر التمییز نظریة أعمال السیادة عن النظریات الأخرى، فقد لقیت
أعمال السیادة انتقاداً واسعاً من طرف الفقهاء الفرنسیین لخطورتها القانونیة لكن القضاء لم
یستجب لهذا الرأي، وتطرقنا إلى بعض النماذج العربیة في اعتمادها على نظریة أعمال
السیادةوطریقة توظیفها في القضاء، حیث هدفت الدراسة إلى تبیان مفهوم نظریة أعمال
السیادة وتحدید اتجاه المشرع منها، اعتمدنا على المنهج المقارن، وفي الأخیر ختمنا دراستنا
بالنتائج والاقتراحات التي توصلنا إلیها .

Abstract :
This study deals with the theory of acts of sovereignty, a comparative
study, and it is one of the issues of administrative law and constitutional law
together. The study consisted of a group of questions, including what is the work
of sovereignty? What are the criteria for the theory of acts of sovereignty over
other theories? The actions of sovereignty have been widely criticized by French
jurists because of their legal seriousness, but the judiciary did not respond to this
opinion, and we touched upon some Arab models in their reliance on the theory
of acts of sovereignty and the method of employing it in the judiciary, where the
study aimed to show The concept of the theory of sovereignty works and
determining the direction of legislators thereof, it adopted the comparative
approach, and in the end we concluded our study with the results and proposals
that we reached.
