Abstract
جند المشرع الجزائري ترسانة من القوانين سواء على المستوى الإداري أو القضائي، خدمة للمستهلك وهذا قصد السماح بتوفير حماية أكبر له من خلال تقديمه على أنه أساس العملية الإستهلاكية وأن المنتجات والخدمات يجب أن توافقه بدرجة كبيرة كما ضمن تدخل أجهزة القضاء في عملية المتابعة والتحري بالإضافة إلى إشراك الفرد في عملية الرقابة والتبليغ سواء كان فردا أو جماعة عن طريق الجمعيات وكذا خلق هيئات متخصصة لطرح مختلف المشاكل وتسجيل المخالفات، كما سمح بحق رفع الدعوى لصالح المستهلك حال وقوع الضرر مع تعيين خبرة في هذا المجال كون الضرر يصبح خطر على الصالح العام، ليعمل على تشديد الأحكام الصادرة في هذا الشأن.
لكن بالرغم من ذلك نلاحظ أن هناك فرق شاسع بين الفكر والتطبيق حيث تبقى هذه القوانين دون جدوى في ظل عاملين رئيسيين يحولان دون نجاح العملية واللذان يتمثلان في نقص الثقافة الإستهلاكية والفساد الإداري.
Abstract
The Algerian legislator recruited an arsenal of laws, both administrative and judicial, to serve the consumer, in order to allow the provision of greater protection by providing it as the basis of the consumer process and that the products and services must be very much compatible with the intervention of the judiciary in the process of follow-up and investigation in addition to the involvement of the individual In the process of monitoring and reporting, whether individual or group through associations, as well as the creation of specialized bodies to raise the various problems and record violations, and allowed the right to bring the case in favor of the consumer in the event of damage with the appointment of experience in this area that the damage becomes a threat to the public interest, To tighten the verdicts issued in this regard.
However, we note that there is a huge difference between thought and practice, where these laws remain ineffective under two main factors that prevent the success of the process, which are the lack of consumer culture and administrative corruptio
