Abstract
الأسرة تعتبـر المحضن الأول للطـفل، والمنبع الأساسي لتكوين مجتمع فاضل متماسك كالبنيان المرصوص، فكل الشرائع تطمح منذ الأزل إلى بلوغ هذا المقصد،لأن صلاح الأمة لا يكون إلا بصلاح الأسرة. وقد اهتمت الشريعة الإسلامية بالأسرة نظرا لدورها الفعال والمباشر في تنشئة الفرد، ونظرا لأهميتها الكبيرة فقد تعرض القرآن الكريم إلى موضوع الأسرة وبين حقوق وواجبات كل من الزوج والزوجة، وذلك بداية من ارتباط الرجل بالمرأة شرعا والذي سماه القرآن الحكيم بالميثاق الغليظ وهذا لقداسته عند الله وهذا استنادا للحديث الذي رواه أبو داود عن أبى هريرة أن النبي ص قال " إن الله يقول: أنا ثالث الشريكين ما لم يخن أحدهما صاحبه فإذا خانه خرجت من بينهما " في الحديث إلى انحلال هذه الرابطة والآثار المترتبة عنها.
فالأسرة إذا تولد كما يولد الطفل، وفترة حملها تطول أو تقتصر حسب الظروف والإمكانات ومقدار الاهتمام بها الهيئة التي تترأس ذلك المجتمع عن طريق نصوص قانونية تضبطها وتحميها وبرامج ومؤسسة تقوم بتوعيتها من العواصف الخطيرة والتي تتمثل في: (العولمة – الغزو الثقافي – الجندر – وسائل التكنولوجيا الحدية) والتي تؤدي غالبا إلى إجهاض هذه الأسرة قبل ولادتها، أو ولادة مشوهة فتصبح عالة على المجتمع وبرامج ومؤسسات تهيئها.

Abstract:
The family is the first incubator for the child, and the main source for the formation of a virtuous and cohesive society, as the Prophet of God, may God bless him and grant him peace, said. The Islamic Sharia has focused on the family due to its effective and direct role in the upbringing of the individual, and due to its great importance, the Holy Qur’an has exposed the issue of the family and between the rights and duties of both the husband and the wife, starting from the legally binding of men and women, which the wise Qur’an called the heavy charter and this is for its holiness with God and this Based on the hadith narrated by Abu Dawood on the authority of Abu Hurairah that the Prophet, may God bless him and grant him peace, said, “God says: I am the third of the two partners, as long as one of them does not betray his companion, and if he betrays him, I leave between them.”
