Abstract
الصفقات العمومية اداة إلنفاق المال العام، لذلك فهي من بين المجاالت الخصبة
إلمكانية إهداره وتبديده واساءة استعماله، مم يستدعي خلق اليات لحمايته والحفاظ عليه وهو
ماال يمكن ان يتحقق إال بمراعاة مبادئ حرية الوصول للطلبات العمومية والمساو اة في
التعامل بين المرشحين المتنافسين وشفافية اإلجراءات وتكريس مزيد من مبادئ الحوكمة
الرشيدة.
تمكن قواعد منافسة اإلدارة من استخدام الموارد العمومية استخداما رشيدا وعقالنيا، بما
تمنحه من تنوع في العروض ف يضفي على طلباتها قدرا من الشفافية والنزاهة، لذلك اولى
المشرع الجزائري لموضوع مبدأ المنافسة في الصفقات العمومية اهتماما خاصا لفرض إحترام
قواعد السوق بين المتعاملين اإلقتصاديين، وقمع جميع الممارسات المنافية لقواعد النزاهة
والمنافسة.
Abstract:
Public procurement is a tool for spending public money, so it is among the
fertile areas for the possibility of wasting it, wasting it and misusing it, which
calls for the creation of mechanisms to protect it and preserve it, which can only
be achieved by respecting the principles of freedom of access to public requests,
equality in the treatment of competing candidates, transparency of procedures
and commitment to more principles of good governance.
The rules of competition allow the administration to use public resources in a
rational and rational way, offering it a variety of offers, which gives its demands
a degree of transparency and integrity.Thus, the legislator Algerian government
has paid particular attention to the question of the principle of competition in
public transactions to impose respect for the rules of the market between
economic operators, and to suppress all practices contrary to the rules of probity
and competition.
