Abstract
إن عدم إفشاء أسرار الوظيفة العامة من الالتزامات الأساسية الملقاة على كافة أعوان الدولة، والتي نصت عليها كافة القوانين المتعلقة بالوظيفة العامة، يشترط فيه على الموظف العام عدم الإفصاح عن المعلومات التي اطلع عليها بحكم وظيفته أما، أساس هذا الواجب فيتمثل في حماية مصلحة الأفراد الشخصية من وجهة حماية المصلحة العامة لضمان الثقة بين الموظف العام و المستفيدين من خدمات الإدارة من جهة أخرى، كما يترتب على مخالف هذا الالتزام تسليط عقوبة متمثلة في العقوبة التأديبية، وقد تتعدى إلى العقوبة الجزائية.

Abstract: The disclosure of secrets in the public function is one of the most basic duties of public employees، it has been confirmed in all Algerian public function laws، the main interest of this duty is to protect the personal interests of people from one hand and the protection of the publics one on the other hand، in order to guarantee the trust between the employee and the administration recipients، like all duties and law obligations every employee who violates this law is punished with the disciplinary punishment and it can surpass that to the penal Punishment.
