Abstract
تعتبر هيئات الضمان الاجتماعي أدات فعالة في تنفيد سياسة الدولة، فهي شريان الحياة الاجتماعية والاقتصادية للوطن، تقوم بتسير مشارعها عن طريق الصفقات العمومية، التي تعتبر المجال الخصب لتسريع وتيرة التنمية ومواكبة التغيرات الداخلية والخارجية، غير أنها تخضع الى خصوصية إجراءات إبرامها في ظل إحترام المبادئ الأساسية للتعاقد من حرية الوصول للطلبات، شفافية الإجراءات والمساواة بين المرشحين حفظا على المال العام والمصلحة العمومية،هذا مأكده المشرع في المرسوم الرئاسي 15-247 وفي هذه الدراسة تم التطرق الى الصندوق الوطني للتأمينات الاجتماعية للعمال الأجراء، اعتمدت لتسير مشاريعه اعداد اجراءات خاصة مدونة في منشور مصادق عليها من طرف الوصايا وزارة العمل والتشغيل والضمان الاجتماعي مع أخذ تنظيم الصفقات العمومية مرجعا لها في ذالك.
Abstract
Social security bodies are considered an effective tool in implementing the state’s policy. They are the lifeblood of the country’s social and economic life. They conduct their projects through public deals, which are considered the fertile ground for accelerating the pace of development and keeping up with internal and external changes. However, they are subject to the privacy of their conclusion procedures in light of respecting the basic principles of contracting from freedom of access to requests, transparency of procedures and equality between candidates in order to preserve public money and the public interest which was confirmed by the legislator in Presidential Decree 15-247. This study has addressed the National Fund for Social Insurance for Workers. To run their projects, they have adopted the preparation of special procedures recorded in a circular approved by the commandments of the Ministry of Labour, Employment and Social Security, taking the regulation of public deals as a reference
