�عز�ز ز�نب2023-07-092023-07-092023http://dspace.univ-msila.dz:8080//xmlui/handle/123456789/40077دت ثورة المعلومات والاتصالات الحدیثة، و ما رافقها من تطور علمي وتقني رهیب إلى انتشار ش�كة الانترنت، و التعجیل �ظهور التجارة الالكترون�ة التي تقوم على عرض السلع والخدمات المختلفة عن طر�ق الوسائل الالكترون�ة، حیث أص�ح �إمكان المستهلك التسوق دون مغادرة مكان جلوسه و دون الالتقاء �المنتج أو ال�ائع (المورد)، و دفع ق�مة ما �طل�ه من السلع وخدمات عن طر�ق وسائل الدفع الالكترون�ة من �طاقات ائتمان وغیرها، و كنت�جة لهذا التطور الكبیر �ان لابد من حما�ة المستهلك من الاعتداءات التي تقع عل�ه في مجال التجارة الالكترون�ة �ونه �مثل الطرف الضع�ف في التعاقد الذي یتم في فضاء افتراضي مع شخص لا �عرفه و لا �عرف مكان تواجده، مما یوقعه ضح�ة جرائم تقلید�ة أو مستحدثة �ل ذلك دفـع المشـرع الجزائـري ً خاصة ً و التشـر�عات العالم�ة عامة لمواك�ة هذه التطورات و�عطاء حما�ة أكثر للمستهلكین في هذا المجال، وحتى لا �كون المستهلك ضح�ة لهاته الجرائم قام المشرع الجزائري بوضع قانون یتعلق �التجارة الالكترون�ة 18-05 إلى جانب قانون حما�ة المستهلك و قمع الغش 09-03 و قانون العقو�ات...إلخ، و لعل �ل هذا �ساهم في تحقیق الحما�ة للمستهلك سواء المدن�ة أو الجنائ�ة، �اعت�اره الطرف الضع�ف في العمل�ة التعاقد�ة. الكلمات المفتاح�ة: المستهلك، التجارة الالكترون�ة، جرائم، قانون التجارة الالكترون�ة، قانون حما�ة المستهلك وقمع الغش، حما�ة. Abstract The modern information and communication revolution, accompanied by a terrible scientific and technical development, led to the spread of the internet , and accelerated the emergence of electronic commerce, based on various goods and services through electronic means, where the consumer became able to shop without leaving his seat and without meeting with the producer or seller (supplier), and pay the value of the goods and services he what he signs All this prompted the Algerian legislature, in particular, and international legislation in general, to keep abreast of these developments and give more protection to consumers in this area, and in order for consumer not to be a victim of these crimes, the Algerian Legislature has developed a law on electronic commerce 18-05, along with the consumer protection and fraud suppression law 09-03, the Penal Code...Perhaps all this contributes to the achievement of consumer protection both civil and criminal as a vulnerable party to the contractual process.
