يمينة ذواديحميدة لوبادي2025-07-102025-07-102025-06-20https://repository.univ-msila.dz/handle/123456789/46959تشكّل هذه الرّسالة دراسة قانونيّة تحليليّة لخروقات وانتهاكات الاحتلال الصّهيونيّ لمبادئ القانون الدّوليّ الإنسانيّ خلال معركة" طوفان الأقصى" الّتي انطلقت منذ 7/10/2023، حيث سلّطت الضّوء على حجم الجرائم المرتكبة بحق سكان قطاع غزّة، في ظلّ حملة عسكريّة همجيّة. انطلقت الدّراسة من الإطار القانونيّ الّذي ينظّم النّزاعات المسلّحة المؤَسّس على اتّفاقيّات جنيف و البروتوكولات الملحقة بها، ونظام روما الأساسيّ للمحكمة الجنائيّة الدّوليّة، ليتبيّن من خلال المعطيات والتّوثيقات الميدانيّة المختلفة أنّ الاحتلال الصّهيونيّ قد ارتكب انتهاكات جسيمة ارتقت لتشكّل جريمة إبادة جماعيّة،حيث تأكّد قيام الاحتلال بأعمال قتل عشوائيّ للمدنيّين، وتدمير ممنهج للبنية التّحتيّة، و فرض حصار شامل أتى على مقوّمات الحياة الأساسيّة في القطاع ما أبان على وجود وتوافر القصد الجنائيّ لإبادة جزء من الشّعب الفلسطينيّ. في الأخير خلصت الدّراسة إلى أنّ الإفلات من العقاب في ظلّ ضعف آليات المساءلة الدّوليّة يشكّل خطرا على مصداقيّة القانون الدّوليّ الإنسانيّ، الأمر الّذي يستدعي تحالف القوى الدّوليّة وتحرّكها قانونيّا لملاحقة الجناة وإعادة الاعتبار للنّظام القانونيّ الدّوليّ. This thesis presents an analytical legal study of the Israeli entity’s violations of international humanitarian law principles during the "TofanAl-Aqsa " battle that commenced on October 7, 2023. It highlights the scale of crimes committed against the population of the Gaza Strip amid a brutal military campaign. The study builds on the legal framework governing armed conflicts, established by the Geneva Conventions and their Additional Protocols, alongside the Rome Statute of the International Criminal Court. Through field documentation and evidence, it demonstrates that the Israeli entity has committed grave violations amounting to genocide. These include indiscriminate killing of civilians, systematic destruction of infrastructure, and a comprehensive siege that has eradicated essential life necessities in Gaza—confirming the genocidal intent to destroy part of the Palestinian people. Ultimately, the study concludes that impunity—fueled by weak international accountability mechanisms—threatens the credibility of international humanitarian law. This necessitates a coalition of global powers and legal action to prosecute perpetrators and restore the integrity of the international legal system.otherThesis
