عبد الرؤوف شنن - عبد الحكيم بوعفار2021-09-262021-09-262021https://repository.univ-msila.dz/handle/123456789/26561لقد ساهم انتشارُ الآلات في بيئة العمل في تسهيل مهامِّ العمّالِ الأُجراء، غير أنّه تضاعفت الأخطارُ المهنيةُ النّاجمة عن استخدامها، بل أضحى يهدّدُ أمنَهم وصحّتَهم؛ الأمرُ الذي أرهقَ المستخدِمَ بنفقاتٍ اقتصاديةٍ إضافية كان في غِنًى عنها، ودفَع المشرّعَ إلى التّدخّلِ لِوضع نصوصٍ قانونيةٍ تهدفُ للحفاظ على صحّةِ العامل في بيئة العمل. إنّ التزامَ السّلامةِ والصّحّةِ المهنية في بيئة العملِ موضوعٌ يَهمُّ أطرافَ علاقةِ العمل ويتعدّاهم إلى السّلطاتِ العامّة، ويُفتَرضُ فيها أن تسريَ في ظروفٍ يسودها الأمنُ والنّظافةُ بالدّرجة الأولى. ولِذا أوجبَ المشرِّعُ الجزائري من خلال قانونِ العمل ضرورةَ توفير بيئة ومُناخٍ يستطيع العاملُ من خلالهما - بعد الاطّلاع على أحكامه ونصوصِه- حمايةَ نفسِه والمطالَبة بحقوقه في ظلّ ذلك القانون. الكلمات المفتاحية: بيئة العمل، التزامُ السّلامة والصّحّة المهنية، الأخطار المهنية، الوقاية والحماية، المسؤولية المدنية والجزائية، القانون الاجتماعي، الإصابات المهنية. Abstract: The spread of machines in the work environment has facilitated the tasks of wage-earners, but the occupational hazards resulting from their use have multiplied, and even threatened their security and health.Which exhausted the user with additional economic expenses that were indispensable, and prompted the legislator to intervene to develop legal texts aimed at preserving the health of the worker in the work environment. The commitment to occupational safety and health and the work environment is a topic that concerns the parties to the work relationship and transcends them to the public authorities, in which it is supposed to apply In conditions of security and cleanliness in the first place.. The Algerian legislator, through the labor law, gave priority to creating an environment and climate in which the worker, after perusal of its provisions and texts, could protect himself and demand his rights.
