روابح صليحةقيرش هندة2025-07-092025-07-092025-06-20https://repository.univ-msila.dz/handle/123456789/46831"إن من الاهداف الرئيسية التي سطرت لانجاز هذا البحث هو بيان اهمية الاستحسان كدليل عقلي يلجا إليه المجتهد باصدار الاحكام الشرعية يستند الى جميع الأدلة المعتبرةمن الشرع من كتاب، وسنةواجماعة وقياسة ومراعاة للخلاف وسدا لذريعةورفعا للحرج ومصلحة للناسوغيرها. ولبيان ان الاستحسان أصل من أصول الإمام مالك- رحمه الله- اتخذنا كتاب البيان والتحصيل والشرح والتوجيه والتعليل ليكون أرضا خصبة لدراسة بعض من المسائل من كتاب( الوضوءوالصلاة)و كذا مسائل من كتاب( الصيام واحكام الجنائز) في باب العبادات ومسائل مختارة من باب (الغصب والشركة) وأيضا مسائل مختارة من كتاب( القراض والوصايا) في باب المعاملات وجعلنا ايضا في ذلك نصيبا لبعض المسائل المختارةمن كتاب الجامع،وكانت الأداة الموصله لإكتشاف أن أصل الاستحسان يعد أحد ركائز المذهب المالكي هو"التخريج الفقهي" فجعلنا لهم بحثا كاملا شرحنا فيه كل متعلقاته. وفي الاخير خلصنا ان من مميزات المذهب المالكي المرونة، والحيوية والثراء الشيء الذي سرع من انتشاره باعتماده كمرجع في الفتوى. One of the main objectives set for the completion of this research is to highlight the importance of istihsan (juridical preference) as a rational evidence to which a mujtahid (independent jurist) resorts when issuing legal rulings. This principle relies on all recognized sources of Islamic law, including the Qur’an, the Sunnah, consensus (ijma‘), analogy (qiyas), consideration of disagreement, blocking the means (sadd al-dhara’i‘), removal of hardship, serving public interest (maslaha), and others. To demonstrate that istihsan is one of the foundational principles of Imam Malik (may Allah have mercy on him), we selected the book al-Bayan wa al-Tahsil, with its commentary, analysis, and reasoning, as fertile ground for studying selected issues. These include topics from the Book of Purification and Prayer, as well as from the Book of Fasting and Funeral Rulings under the category of acts of worship, and selected issues from the Book of Usurpation and Partnership, as well as from the Book of Qirad (silent partnership) and Wills under the category of financial transactions. We also included selected issues from the Book of al-Jami‘. The key method used to uncover that istihsan is indeed one of the cornerstones of the Maliki school was fiqhi takhrij (juridical extraction), and for this, we dedicated a full study explaining all of its aspects. In conclusion, we found that one of the main features of the Maliki school is its flexibility, vitality, and richness—qualities that greatly contributed to its rapid spread and its adoption as a primary source for legal opinions.otherThesis
