| dc.description.abstract | يهدف البحث إلى توضيح الإطار المفاهيمي للنزاعات الحدودية الدولية وتحليل دور محكمة العدل الدولية في تسوية هذه النزاعات، مع دراسة حكم المحكمة في قضية النزاع الحدودي بين قطر والبحرين، كما يتناول السياق التاريخي والسياسي للنزاع، ويقدم إسهامًا في إثراء الأدبيات القانونية المتعلقة بحل النزاعات الدولية، وقد خلص البحث إلى أن محكمة العدل الدولية تسهم بشكل كبير في حل النزاعات الحدودية بناءً على القانون الدولي، معتمدًا على الوثائق التاريخية والمعاهدات السابقة لتحديد الحدود، ساهم حكم المحكمة في تقليل التوترات بين قطر والبحرين، وأوضح المبادئ القانونية المستخدمة في فض النزاعات الحدودية، كما أظهر البحث أن اللجوء إلى محكمة العدل الدولية يوفر حلاً أسرع وأكثر سلمية من الحلول العسكرية، كما تم تقديم بعض الاقتراحات، مثل تشجيع الدول على اللجوء إلى القضاء الدولي بدلاً من الحلول العسكرية، وتعزيز التنسيق بين الدول لضمان الالتزام بأحكام المحكمة، وتوسيع نطاق نظر المحكمة في النزاعات الحدودية الأخرى. The research aims to clarify the conceptual framework of international boundary disputes and analyze the role of the International Court of Justice in resolving these disputes, with a study of the Court's ruling in the border dispute case between Qatar and Bahrain. It also addresses the historical and political context of the dispute and contributes to enriching the legal literature on international dispute resolution. The research concluded that the International Court of Justice plays a significant role in resolving border disputes based on international law, relying on historical documents and previous treaties to determine borders. The Court's ruling helped reduce tensions between Qatar and Bahrain and clarified the legal principles used in resolving border disputes. The research also showed that resorting to the International Court of Justice provides a faster and more peaceful solution compared to military options. Some suggestions were offered, such as encouraging countries to resort to international courts instead of military solutions, enhancing coordination among countries to ensure compliance with the Court's rulings, and expanding the Court's jurisdiction over other border disputes. | |
