| dc.description | This study aims to show the impact of the purpose of facilitation on the rulings of named contracts, across their various types and patterns -whether compensatory or donation- which are considered fundamental rulings for all transaction contracts. Through demonstrating its effect in terms of their ruling and the purpose behind their legislation, as well as in terms of their establishment on foundational pillars, governing conditions, their diversity and multiple patterns, including their subdivisions, exceptions, and incidental circumstances, based on tracking and examining the relevant textual evidence. In conclusion, it became clear that the wise legislator considered facilitation in legislating their rulings, both originally and exceptionally, permanently and temporarily, whether through the rulings of compensatory contracts like marriage and its incidental matters, or through the rulings of contracts similar to sales, across their various types and forms including partnerships, reconciliation, leasing, donations, safekeeping, and documentation. | |
| dc.description.abstract | تهدِفُ هذه الدراسة إلى إبراز أثر مقصد التيسير في أحكام العقود المسمّاة، على مُختلف أنواعها وأنماطها -معاوضة أم تبرّعاً-، والتي تُعتبر أحكامها أساساً لسائر عقود المعاملات، وذلك ببيان أثره من جهة حُكمها والحكمة من تشريعها، ومن جهة تأسيسها على أركان تقوم عليها، وشروط تنضبط بها، ومن جهة تنوعها وتعدّد أنماطها، وما يندرج تحتها من فروع، وما يُستثنى منها، وما يطرأ عليها من عوارض، بناءً على تتبّع واستقراء النصوص الواردة في شأنها. فتبيّن من خلال ذلك أنّ الشارع الحكيم راعى التيسير في تشريع أحكامها، أصالة واستثناءً، دواماً وتأقيتاً، سواء من خلال أحكام عقود المعاوضات كالنكاح وعوارضه ومسائله، والبيع وما يندرج تحته من العقود كالسّلم والصّرف ونحوهما، أو من خلال أحكام العقود المشاكلة للبيع، على مختلف أنماطها وأشكالها من شركات، وصُلح وإجارة، وهبات وحفظ وتوثيق. | |
