| dc.description.abstract | مر الإضراب في الجزائر بمراحل عديدة إلى غاية تكريسه دستورياً كحق من الحقوق الأساسية للعمال والموظفين، بداية تم الاعتراف بهذا الحق بعد صدور دستور 1963، لكنه بقي جامداً حيث لم يدعم بأي قانون يبين كيفية ممارسته، وبقي الامر كذلك إلى غاية الافراج عن دستور 1976 والذي كان موجهاً لعمال القطاع الخاص دون غيرهم، وأخيرا تم الاعتراف الكلي بالإضراب في القطاعين العام والخاص مع إحالة عملية تنظيمه على القانون، وطبقاً لذلك صدرت عدة قوانين آخرها القانون رقم 23-08 الذي بين الإجراءات القانونية للممارسة الشرعية للإضراب، كما بين القيود الواردة على هذه الممارسة التي تضمن التوازن بين الحق في الإضراب واستمرار نشاط المرافق العمومية بانتظام واطراد. The strike in Algeria went through several stages until it was constitutionally enshrined as a fundamental right for workers and employees. Initially, this right was recognized after the promulgation of the 1963 Constitution. However, it remained stagnant, as it was not supported by any law defining how it should be practised. This remained the case until the promulgation of the 1976 Constitution, which was directed exclusively at private sector workers. Finally, strikes were fully recognized in both public and private sectors, with the process of regulating them to the law. In accordance with this, several laws were issued, the most recent of which was Law. № 23-08, which clarified the legal procedures for the legitimate practices of strikes. It also clarified the restrictions on this practice, ensuring a balancé between the right to strike and the continuity in the activities of public utilities regularly and steadily. | |
