| dc.description.abstract | لا شك أن الأسرة هي الخلية الأساسية والحساسة داخل كل مجتمع لذلك عنيت بأهمية كبيرة سواء في الفقه الإسلامي أو القانون الوضعي وهذا ما تجلى في القوانين التي جاءت رادعة لكل من يحاول أن يخل بكيانها أو يحاول تفكيكها وخلال هذه الدراسة تطرقنا إلى تعريف الأسرة والحماية الجنائية لها كما عرجنا على كيفية إنشاء هذه الرابطة الأسرية وصولا إلى مكانتها ثم تطرقنا في الفصل الثاني من الدراسة إلى الجرائم المخلة بالرابطة الأسرية وكيف تعامل كل من الفقه والقانون تجاه هذه الجرائم وختمناه بتأثير القرابة في درجة العقوبة فتارة تكون سببا في تشديد العقوبة وتارة في تشديدها There Is no doubt That the famile That the famile Is the basic and sensitive cell within Evry society, So I was concerned with Great importance, whether in Islamique jurisprudence or positive Law, and This was évident in the laws That came as a déterrent to everyone who tries to violète its existence or tries to dismantle It and during This study we touched on the définition of the famile and criminel protection for It as well. We discussed how Thisfamile bond was established to reach its position, then we discussed in the second chapter of the study the crimes Thatviolète the famile bond and how both jurisprudence and Law dealt with these crimes and concluded It with the effect of kinship in the dégrée of punishment, sometimes ItIs a reason for the severity of the punishment and sometimes its severity. | en_US |
