| dc.description.abstract | يعتبر موضوع نقل وزرع الأعضاء من المواضيع ذات الصدى الواسع والجدل الكبير؛ ذلك لأنها من العمليات التي يكون فيها الإنسان على طاولة الحياة أو الموت؛ ولذا كان من الواجب تأطير ضوابط شرعية وقانونية صارمة تحكم هذه العمليات العلاجية؛ لتحقيق المصلحة المنوطة لها. هذا؛ وقد رتّب الفقه الاسلامي والقانون الوضعي مسؤولية تقع على عاتق المتبرع أو الطبيب حال حدوث الخطأ والضرر؛ مع معاينة وتقدير لهما ليتم تحديد التعويض المناسب، وترتفع درجة المسؤولية من التعويض إلى العقوبة حال استغلال الحرمة البشرية أثناء الحياة أو بعد الموت. The topic of organ removal and transplantation is one of significant resonance and considerable controversy, as it involves procedures where a person may be on the verge of life or death. Therefore, it is essential to establish strict legal and religious frameworks to govern these medical procedures, ensuring the intended benefits are realized. Islamic jurisprudence and civil law have both established accountability for either the donor or the physician in cases of error or harm, with an evaluation process in place to determine appropriate compensation. The level of responsibility escalates from compensation to criminal punishment when the sanctity of human life is violated, whether in life or death. | |
