| dc.description.abstract | يتركز موضوع بحثنا حول بيع ملك الغير مقارنا بين الفقه الإسلامي والقانون الجزائري، أبرزنا فيه مفهوم هذا البيع وكذا طبيعته، والقواعد التي تنظمه، بين المتعاقدين والغير على حد سواء، وهذا ما نراه في الواقع العملي لحياة الناس، محاولين بذلك تبيين مركز كل من الأطراف (البائع والمشتري، والمالك الحقيقي للمبيع)، وأثر هذا العقد عليهم، من جانبي: الفقه الإسلامي والقانون الجزائري.
