Abstract
تزخر الحضارة الإسلامية برصيد وافر في شت العلوم الدينية والدنيوية التي كانت المقوم الرئيس في النهوض والازدهار والرقي أن ذاك ، ابتداء من مهبط الوحي مكة والمدينة ومروراً ببلاد الرافدين والشام شرقاً وامتدت إلى شمال إفريقية القيروان والمغرب الأوسط والمغرب الأقصى إلى أن وصلت بلد الأندلس غرباً ، التي كانت في أوجّ رقيها وحضاراتها بجامعاتها كقرطبة وعلمائها ، فبرز فيها علماء وفقهاء كبار بعلومهم وتصانيفهم وآثارهم ، ومن بين هؤلاء الفقهاء والعلماء سطع نجم الإمام عبد الملك ابن حبيب "رحمه الله" وجعل درجته في عليين الذي نقل مذهب إمام دار الهجرة مالك بن أنس" رحمه الله " عن طريق تلاميذه مثل ابن الماجشون وأصبغ وغيرهم ، وأبدع فيه بتصانيف ومؤلفات احتوت على علوم المذهب المالكي وبعض الآراء والاختيارات التي كانت من اجتهاداته الخاصة ،فقد كان ابن حبيب مجتهد في المذهب فلم يخرج عن المذهب إلاّ في حالات معينة رأى الحق في غيرها ، والتي كانت سبب بحثنا من حيث الموافقة أو المخالفة لمشهور المذهب ، والمساهمة في الحضارة الإسلامي، ويد في إحياء هذا التراث الإسلامي ،وربط الحاضر بالماضي ،وبعث الهمم في النفوس المحبطة المتأثرة بالحضارة الغربية الحديثة ،وبيان جهود الأئمة والعلماء وفقهاء في شت العلوم ، لعلنا نصل إلى المطلوب المنشود .
وكان ذلك بدراسة اختيارات ابن حبيب من كتاب النوادر والزيادات للإمام ابن أبي زيد القيرواني الذي اعتنى بآراء ابن حبيب وغيره من الأئمة في شت أبواب الفقه، والذي كان علينا دراسته أبوابه محصورة ومقصورة على " كتاب الصلاة باب النوافل والعيدين والكسوف وباب الجنائز " .
فخرجنا بحملة من التوصيات والمقترحات.
Summary
Islamiccivilizationisrichlyendowedwith a vastheritage in bothreligious and worldly sciences, whichserved as a foundationalpillar for its revival, prosperity, and advancement at the time. This legacyoriginatedfrom the cradle of revelation, the cities of Mecca and Medina. It extendedthrough the lands of Mesopotamia and the Levant in the East, reaching North Africa—al-Qayrawān, the Central Maghreb, and the Far Maghreb, culminating in al-Andalus in the West. Al-Andalus, duringits golden age, reached the pinnacle of intellectual and cultural excellence, particularlythroughitsrenowneduniversities, such as Córdoba, and itsdistinguished scholars. Among the eminentjurists and scholars whoemergedduringthisperiodwas the illustrious Imam ʿAbd al-Malik ibn Ḥabīb (may Allah have mercy on him and granthim the highestrank in Paradise). He played a significantrole in transmitting the school of the Imam of the City of Migration, Mālik ibn Anas (may Allah have mercy on him), throughhisstudentssuch as Ibn al-Mājishūn, Aṣbagh, and others.
Ibn Ḥabībcontributedcreatively to the Mālikīschoolthroughhisworks and writings, whichincludedboth the established doctrines of the school and hisindependentlegaljudgments. Althoughhegenerallyadhered to the Mālikīschool, heoccasionallydepartedfromitswell-known positions whenhefound the truthlayelsewhere. These instances form the core of ourresearch, which examines the extent to whichhis positions alignwith or diverge from the dominant viewswithin the school, and how theycontribute to Islamiccivilization. This studyalsoaims to revive the Islamicintellectuallegacy, connect the presentwith the past, and inspire discouraged souls influenced by modern Western civilization by highlighting the efforts of Muslim imams, scholars, and juristsacrossvarious disciplines.
Our researchfocused on studying the legalpreferences (ikhtiyārāt) of Ibn Ḥabīb as recorded in al-Nawādirwa-l-Ziyādāt by Imam Ibn Abī Zayd al-Qayrawānī, whopreserved the views of Ibn Ḥabīb and other imams acrossvarious branches of jurisprudence. The scope of ourstudywaslimited to selected sections of thiswork, namely: "The Book of Prayer" (Kitāb al-Ṣalāh), specifically the chapters on supererogatoryprayers, the twoEids, and eclipses, as well as the chapter on funerals (janāʾiz).
Our studyconcludeswith a series of recommendations and proposals.
