| dc.description.abstract | تهدف هذه الدراسة إلى التعرف على أحكام عقد الهبة من خلال مقارنة بين ما جاء به الفقه الإسلامي وما نص عليه قانون الأسرة الجزائري، خاصة في المواد من 202 إلى 212. وتتمثل الإشكالية الأساسية في مدى توافق هذه الأحكام القانونية مع مبادئ الشريعة الإسلامية، مع التركيز على أوجه الاتفاق والاختلاف بين الجانبين. كما تسعى الدراسة إلى بيان أهمية الهبة كتصرف فيه إحسان وله أثر ديني واجتماعي وقانوني، إضافة إلى توضيح القواعد التي تنظمها في القانون، مما يفيد القضاة والمحامين عند التعامل مع قضايا الهبة. وتم الاعتماد في هذا البحث على الاستدلال بالنصوص الشرعية و القانونية مع الاستئناس ببعض الأحكام القضائية المتعلقة بالهبة. This study aims to explore the provisions related to the contract of donation (hiba) through a comparative analysis between Islamic jurisprudence and the Algerian Family Code, particularly Articles 202 to 212. The main issue lies in the extent to which these legal provisions align with the principles of Islamic law, with a focus on the similarities and differences between the two systems. The study also seeks to highlight the importance of donation as a benevolent act with religious, social, and legal implications, in addition to clarifying the legal framework that governs it, which benefits judges and legal practitioners in dealing with related cases.
