| dc.description.abstract | تناولت الدّراسة جهودالإمامالقاضيأبيبكرابنالعربيالمالكيفيتأصيلفقهالمعاملاتالمالية،بالاعتمادعلىمنهجهالأصوليالعميقواستنباطاتهالعقليةوالنصية. استعرضتالدّراسةسيرتهالعلمية،ورحلاتهفيطلبالعلم،وتأثرهبالغزاليوالطرطوشي،ومكانتهفيعلومالشريعةوالجهاد،أبرزتمؤلفاتهكـ"أحكامالقرآن" و"العواصممنالقواصم"،واهتمامهبالمقاصدوالأصولفيبناءالأحكام. ركّزالبحثعلىتفسيرهلآيةتحريمأكلالمالبالباطلوآيةالرباباعتبارهماقواعدماليةكبرى. تناولالفصلالأولالأصولالأربعةفيفقهالمعاملاتلديه،وهي: تحريمالباطل،الربا،الغرر،والمقاصد. بينماعرضالفصلالثانيالقواعدالعشرالمستنبطةمنتلكالأصولموزعةعلىأربعةمباحث،شملتالربا،الغش،الجهالة،العُرف،والمصلحة. وأبرزالبحثقابليتهاللتطبيقالمعاصرفيقضاياكالعُملاتالرقميةوخطاباتالضمان This study highlights the scholarly efforts of Imam Al-Qadi Abu Bakr Ibn al-Arabi al-Maliki in establishing the jurisprudence of financial transactions. His approach was rooted in deep fundamentalist principles and reasoned textual interpretation. The research explores his biography, key works—such as Ahkam al-Qur’an and Al-‘Awāṣim min al-Qawāṣim—and his bold use of legal principles and maqāṣid (objectives of Sharia) in deriving rulings. A central focus was his interpretation of key Qur’anic verses, such as the prohibition of consuming wealth unjustly and the verse distinguishing lawful trade from usury. The first chapter analyzed four foundational principles in Ibn al-Arabi’s financial jurisprudence: the prohibitions of false gain, usury, and deception, along with the role of maqāṣid. The second chapter explored ten legal maxims derived from these principles, addressing issues like corruption in contracts, fraud, and the role of custom and public interest. The study emphasized the practical application of these principles in modern contexts such as digital currencies and letters of guarantee, concluding with key findings and recommendations. | |
