Abstract
إن الاعتقاد بفكرة الحرية المطلقة لم يلقى القبول منذ البداية ولذا تبقى نسبية الحرية حقيقة لا مفر منها ،
ولذا تنظيم حياة المجتمعات ضرورة لابد منها وهذا من أجل حماية النظام العام بمختلف عناصره وحماية م ا رفق
الدولة وأملاكها العامة والخاصة، وعليه كان فرض نظام الت ا رخيص ا رجع إلى ضرورة تمكين الإدارة من التدخل
في كيفية القيام ببعض الأنشطة والحريا ت التي يضمنها الدستور وهذا كجانب وقائي من أجل إعطاء توازن للمعادل ة
ممارسة الحرية من جهة، ومن جهة أخرى متطلبات حماية النظام العام وم ا رفق الدولة وأملاكها.
اولهدف من البحث ليس حصر الرخص الإدارية ، ولكن البحث في الرخصة الإدارية كق ا رر من حيث
المجالات العامة المشتركة بينها وبين الق ا ر ا رت الإدارية الأخرى وتبين خصوصيتها ، والبح ث في جانب الحماية
للرخص الإدارية كون تقييد الحرية بنظام الت ا رخيص له غرض حمائي معين، مما سيفرض بعض الاشكالات في
مختلف المجالا ت .
Description
Believing in the idea of absolute freedom has not been accepted from the outset and therefore the relativism of freedom remains an inevitable reality , Therefore, organizing the lives of societies is a necessity, in order to protect public order and the State's facilities and public and private property, The imposition of the licensing system was therefore due to the need to enable the Administration to interfere in how certain activities and freedoms guaranteed by the Constitution are carried out as a preventive aspect in order to give a balance to the freedom equation on the one hand and on the other the requirements for the protection of public order, State facilities and property.
The purpose of the research is not to limit administrative license, However the search of the administrative licence as a decision in terms of the general areas between them and other administrative decisions and indicate its specificity, and research into the protection aspect of administrative licenses that restriction of liberty by the licensing system has a particular protective purpose, which will impose some problems in different fields.
