Abstract
يهدف هذا البحث إلى بيان أهمية أصل سدّ الذّرائع ومنزلته بين الأصول الشّرعية عموما، وأصول المذهب المالكي خصوصا؛ وذلك بذكر مفهوم أصل سد الذّرائع وحجيّته وضوابطه ونماذج تطبيقيّة من خلال كتاب البيان والتّحصيل، متتبعين في ذلك فتاوى الإمام-رحمه الله-، وانتقينا منها نماذج مختارة من كتب متنوعة، لبيان إعمال الإمام مالك-رحمه الله- لأصل سد الذرائع فيها، حيث تأكّد لدينا أنّه أصل من أصول الإمام مالك-رحمه الله- المعتبرة، يعمله متى كان الفعل يؤدي إلى المحظور وكان بعده المآلي يجر مفسدة أو يتحايل بالمباح على المحرّم .
وبهذا يظهر توازن الفقه المالكي من خلال أصل سدّ الذّرائع الّذي يُصْلِح أحوال العباد في أمور دينهم ودنياهم، وهذا حماية لهم من الفتن والأهواء، وكذا إعمالا للأدلة الشرعية لكون المولى _عزّو جل_ رعاها في كثير من الأحكام .
This research aims to clarify the importance and status of the principle of blocking the means ( sadd al-dharia) between the general legal principles and the specific principles of the Maliki school of thought. This will be addressed by defining the concept of Sadd al-dharia, validity, and outlining the rules for its application within presenting practical examples from the book of Al-Bayan wa al-Tahsil.Following the fatwas of the Imam—may Allah have mercy on him—a number of examples have been selected from various books, aiming to demonstrate Imam Malik’s application of the principle of blocking the means (sadd al-dharia). The study confirmed that this principle is among the well-established foundations in Imam Malik’s legal methodology, which he employed whenever an act might lead to a prohibited matter, result in harm, or be used as a legal trick to justify what is unlawful. Imam Malik applied this principle most extensively in matters of worship.
The origin of the principle of blocking the means (sadd al-dharia) ensures balance within the Maliki school of thought, which is also known for its emphasis on public interest. Because the principle of blocking the means (sadd al-dharia) serves as a precaution in matters of religion and a means of restraining personal desires. Despite the criticisms directed at the founder of the school regarding this principle, the scriptural evidence and the legal practices of other schools confirm the legitimacy of the principle of blocking the means and establish it as valid legal proof.
