| dc.description.abstract | تعتبر القواعد الفقهية زبدة الفقه، استخرجها الفقهاء من النصوص الشرعية ومن أقوال الصحابة والتابعين ومن تتبّع الفروع الفقهيّة، ولكلّ هذه القواعد بعد مقاصديّ، يظهر تكامل العلوم الشرعية، ولقد ظهرت في عصرنا النوازل الطبية الكثيرة بسبب التطور العلميّ السريع ممّا أوجب إيجاد أحكام من الشرع وأخرى من القانون الوضعيّ تضبطها، وهذا ما أظهرناه في الأطروحة، كما تم تطبيق هذه القواعد الفقهية ذات البعد المقاصديّ على العديد من النّوازل الطبيّة، واخترنا منها المتعلقة بنقل وزراعة الأعضاء أنموذجا. | |
| dc.description.sponsorship | Islamic legal maxims represent the essence of jurisprudence. They were derived by jurists from religious texts, the sayings of the Companions and their successors, as well as through the study of practical legal cases. These maxims all have a purposeful dimension, reflecting the interconnectedness of Islamic sciences. In our era, rapid scientific advancements have led to numerous unprecedented medical issues, requiring rulings from both Islamic law and positive law to regulate them. This has been addressed in our thesis. The Islamic legal maxims, with their purposeful dimension, have been applied to several contemporary medical issues, among which we have chosen the transfer and transplantation of organs as a case study. | |
