| dc.description.abstract | يدرس موضوع بحثنا هذا مقاصد التشريع الإسلامي في أحكام المواريث، وذلك من خلال الوقوف على جملة من المقاصد التي يهدف التشريع الإسلامي لتحقيقها عند تشريعه لأحكام المواريث، والرد على الشبهات المثارة حول تلك الأحكام، وقد قسم هذا البحث إلى قسمين.الأول: يتضمن أهم المقاصد العامة المستنبطة من آيات المواريث ومن نظام التوريث الإسلامي ككل. والثاني: يتضمن المقاصد الخاصة ببعض أحكام المواريث التعبدية وكذا الاجتهادية، فتوضحت حكمة الله وعلمه بمصالح خلقه وعدالته من خلال تشريعه لأحكام المواريث في أدق تفاصيلها، وبرزت عظمة الشريعة الإسلامية التي لطالما حاول الملحدون تشويهها والتنفير منها بإثارة الشبهات حولها، واختتم هذا البحث بمجموعة من النتائج والتوصيات. This research examines theobjectivesof Islamic legislation in the rulings of inheritance, by exploring some of the aims that Islamic lawseeksto achieve through its inheritance laws, and by responding to some of the misconceptions raised about these rulings. The study is divided into two main sections. The first section discusses some generalobjectivesderived from the Qur'anic verses on inheritance and from the Islamic inheritancesystem as a whole. The second section explores specificobjectivesbehind certain devotional rulings related to inheritance and some rulings based on scholars independent reasoning Through this analysis, the wisdom, knowledge, and justice of Allah in legislating the detailed rules of inheritance becomeevident. It also highlights the greatness of Islamic law, which has long been the target of atheistsattemptingto distort its image and dissuade people from it by stirring doubts. The research concludes with a set of findings and recommendations. | |
