| dc.description.abstract | يعتبر نظام رد الاعتبار وسيلة فعالةفي مكافحة الجريمةسواء في الفقه الاسلامي اوفي القانون الجزائري، لما يتضمنه من اهداف تصب في مصلحة المحكوم عليه فيسعى هذا النظام لإصلاح سلوك المحكوم عليه ومنحه فرصة الانخراط في المجتمع من جديد، كما يُسهم في اعادة اعتباره ومكانتهداخل المجتمع مما يساعد على إصلاحه وتهيئته للاندماج من جديد، ويقلل من احتمالية عودته الى الاجرام مرة اخرى. وقد عرف الفقه الاسلامي نظام رد الاعتبار للمحكوم عليه من خلال نظام التوبة باعتباره وسيلة فعالة لتحقيق الاصلاح الذاتي والرجوع الصادق، في حين نظمه المشرع الجزائري ضمن إطار قانوني محدد من خلال اجراءات وشروط تضبط رد الاعتبار بنوعيه القانوني والقضائي. The system of rehabilitation (Rehabilitation of Offenders) is considered an effective means of combating crime, both in Islamic jurisprudence and in Algerian law, due to its objectives that serve the interests of the convicted person. This system aims to reform the behavior of the offender and grant them a new opportunity to reintegrate into society. It also contributes to restoring their reputation and status within the community, which aids in their rehabilitation and preparation for reintegration, while reducing the likelihood of reoffending. Islamic jurisprudence has recognized the concept of rehabilitation through the system of repentance, viewing it as an effective means of achieving self-reform and sincere return. In contrast, the Algerian legislator has established a specific legal framework for rehabilitation, setting out procedures and conditions that govern both legal and judicial rehabilitation. | |
