Abstract
يتناول هذا البحث موضوعا من أبرز نوازل العصر في مجال الأسرة، وهو الزواج الإلكتروني والزواج المسيار، في ضوء فقه النوازل، وقد جاءت هذه الدراسة لإبراز قدرة الفقه الإسلامي على التعامل مع مستجدات الواقع المعاصر، وتحليل مدى توافقهذه الأنواعالجديدةمنالزواجمعالضوابط الشرعيةومقاصد الشريعة الإسلامية.
تم في هذا البحث تعريف فقه النوازل وبيان ضوابطه ومداركه،وكذاك تعريف الزواج الإلكتروني والزواج المسيار، وبيان صور كل منهما، مع عرض الشروط التي يجب توافرها لصحتهما، كما تم تحليل آراء العلماء والباحثين المعاصرين، ومقارنة أقوال المذاهب الفقهية وموقف المجامع الفقهية الرسمية.
وقد اعتمدت الدراسة على المنهج الفقهي التحليلي المقارن، مع التوصيف الواقعي للمسائل محل البحث، وانتهت إلى جملة من النتائج أبرزها: أن هذه الأنواع من الزواج يمكن أن تكون صحيحة إذا توفرت فيها الشروط الشرعية، غير أن فيها من الجوانب السلبية ما يستوجب الضبط والتنظيم منعًا للانحراف أو الإضرار بمؤسسة الأسرة.
This research deals with one of the most prominent contemporary issues in the field of family, namely electronic marriage and Misyar marriage,Jurisprudence of New Issues. This study aims to highlight the ability of Islamic jurisprudence to deal with the new developments of contemporary reality, and to analyze the extent to which these new types of marriage are compatible with the legal controls and objectives ofIslamic law.
This research defines the jurisprudence of new issues and explains its controls and understandings, as well as the definition of electronic marriage And misyar marriage, The forms of each of them are explained, along with the conditions that must be met for their validity. The opinions of contemporary scholars and researchers are also analyzed, and the statements of the schools of jurisprudence and the positions of the official jurisprudential assemblies are compared.
The study relied on the comparative analytical jurisprudential approach, along with a realistic description of the issues under investigation. It concluded with a number of results, the most prominent of which is that these types of marriage can be valid if they meet the legal conditions. However, they contain negative aspects that require control and regulation to prevent deviation or harm to the family institution.
