| dc.description.abstract | لقد تناولنا في هذه المذكرة جرائم الشركات التجارية في التشريع الجزائري كما تعرفنا على ماهية جريمة الشركات التجارية وذلك ذكر مقوماتها وخصائصها وأركانها ومكوناتها حيث توصلنا إلى أنها كل فعل أو امتناع غير مشروع مرتكب بحسابها من طرف أجهزتها والممثل القانوني لها وتكون هذه الأفعال المخالفة للقوانين وكافة الأنظمة القانونية التي تحكم الشركة التجارية في كافة مراحلها، وحددنا خصائصها في كونها جرائم نفعية ذات آثار وخيمة كما أنها جرائم ذات صفة خاصة وتقنية وتعرفنا على أركانها المتمثلة في الركن الشرعي الركن المادي وكذلك الركن المعنوي كما رأينا ما هي مختلف الجرائم التي تقع على الشركة التجارية في القانون التجاري أثناء تأسيسها وأثناء سيرها وكذا المسؤولية الجزائية للمصفي وكذلك تطرقنا إلى الجرائم التي تقع أثناء سير الشركات التجارية ولكثرة الجرائم حاولنا ذكر ثلاث جرائم المتمثلة في جريمة توزيع الأرباح الصورية وجريمة الاستعمال التعسفي وبعد ذلك ختمنا مذكراتنا بالإطاحة ببعض الجرائم التي تسأل عنها الشركات التجارية سواء ذلك في قانون العقوبات، جريمة تبييض الأموال وغيرها من الجرائم أما في القوانين الخاصة تطرقنا إلى جرائم الصرف وجرائم المخدرات وغيرها. Summary: In this note, we dealt with the crimes of commercial companies in the Algerian legislation. We also learned about the nature of the crime of commercial companies by mentioning its components, characteristics, pillars and components, as we concluded that it is every illegal act or omission committed on its account by its organs and its legal representative,and these acts are in violation of laws and all legal systems that governs the commercial company in all its stages,And we defined their characteristics in that they are utilitarian crimes with serious effects, as they are crimes of a special and technical character, and we got acquainted with their pillars represented in the legal pillar, the material pillar as well as the moral pillar. We also touched onthe crimes that occur during the conduct of commercial companies and the large number of crimes we triedto mention three crimes represented in the crime of distributing fictitious profits and the crime of abusive use, and then we concluded our memos by overthrowing some of the crimes that commercial companies are asking about, whether that is in the Penal Code, the crime ofmoney laundering and other crimes. In special laws, we discussed exchange crimes, drug crimes, and others. | en_US |
