| dc.description.abstract | على إعتبار أن محاكم الجنايات تنظر في أخطر الجرائم، كان من الضروري على المشرع الجزائري أن يعيد النظر في منظومة التقاضي أمامها، فتدارك الوضع بإصدار القانون 17-07الذي جاء في إطار التعديل الدستوري لسنة 2016، وكرس من خلاله مبدأ التقاضي على درجتين أمام محاكم الجنايات، ليكون بذلك قد عزز ضماناتالمحاكمة العادلة بواحد من أهم دعائمهاوفقا للمعايير الدوليةالمعترف بها، ومشكلا تحولا بارزا في النظام القضائي الجزائري بعد أن كانت الأحكام الصادرة في الجنايات لا تقبل الطعن بالإستئناف. Résumé Tout en considérant que les cours d'assises traitent les crimes les plus dangereux, Il était nécessaire que le législateur algérien revoie la poursuite auprès de la cour,C’est ainsi qu'il s'est rattrapé la situation tout en promulguant la loi 17-07 qui a été lancée dans le cadre de l'amendement constitutionnel de 2016 dans lequel il a consacré le principe du contentieux devant les cours d'assises,Tout en renforçant ainsi les garanties d'un procès équitable par l'une de ses convictions les plus importantesconformément aux normes internationales reconnues, et opérant un changement significatif dans le système judiciaire algérien après les verdicts des crimes n'a pas accepté le recours contre l'appel. Abstract Considering that the assize courts handle the most dangerous crimes, it was necessary for the algerianlegislator to reviewthe lawsuit with the court, the case was resolved by issuing law 17-07,which was launched as part of the constitutional amendment of 2016, in which he devoted the principle of litigation before the assize court, thus reinforcing the guarantees of a fair trial by one of its conviction according to recognized international standards, and making the significant change in the algerian judicial system after the verdicts of the crimes did not accept appeal. | en_US |
