| dc.description.abstract | يعتبر مبدأ المساواة احدى المبادئ الأساسية الواجب احترامها,وتطبيقها في الدولة , فلا ينبغي أن يقوم المجتمع على فوارق نابعة من اختلاف الأصل ,أو الجنس ,أوالدين , سواء تعلق الأمر بالمساواة أمام القانون , أو أمام القضاء . إلا أن المشرع تبنى نظام إمتياز التقاضي لبعض الفئات في الدولة بحيث لا يتم اتباع نفس إجراءات التحقيق ,مما فيه خرق أهم مبدأ معترف به على مستوى دساتير كل دول العالم ,وهو مبدأ المساواة. بالإضافة لذلك يؤدي هذا الإجراء إلى تعطيل المتابعة الجزائية لمرتكبي الجرائم ,كما قد يؤدي لإفلاتهم من العقاب . الكلمات المفتاحية : مبدأ المساواة , الدستور الجزائري, التعديل الدستوري,امتياز التقاضي, حق دستوري,العقاب. Résume: Le principe d’égalité est l’un des principes de base a respecter et appliquer dans l’état, Il ne devrait pas être la communauté qui est basée sur différences provienne des déférentes origines, sexe ou religion ; que se soit l’égalité devant la loi ou de la magistrature. Sauf que le législateur a adopté un systéme privilége relatif au litige pour certains groupes dans l'état afin que certaines procédures d'enquéte ne soient pas suivies , pour que le principe le plus important reconnu dans les constitutions de tous les pays du monde .queln est le principe d'égalité. En plus de cette procédure perturbe les poursuites pénales des autres de crimes et peut conduire à l'impunité. Abstract: The principle of equality is one of the basic principles to be respected and applied in the state , it should not be the community which is based on differences comes from the different origins,sex or religion: whether it is equality before the law, or the judiciary.except if the legislator a system of litigation privilege for some groups in the state so that the same procedures of investigation are not followed, so that the most important principle recongnized in the constitutions of all countries of the world . which is the principle equality . In addition to this procedure disrupts the criminal prosecution of the perpetrators crimes ,and may lead to impunity. | en_US |
