dc.description.sponsorshipThis study sheds light on the right to employment as a fundamental human right enshrined in international conventions and national constitutions, with a particular focus on the 2020 Constitution of Algeria. The study differs from economic and policy-based approaches by adopting a purely legal and constitutional analysis of the right to employment as a pillar of social justice and human dignity. The study begins by affirming that employment is not merely a source of income, but a fundamental right that reflects integration into society and active citizenship. Therefore, enshrining this right in the constitution serves as a measure of the state's commitment to human rights. The research traces the evolution of this right in international instruments, particularly:  Article 6 of the International Covenant on Economic, Social and Cultural Rights,  ILO Convention No. 122 on Employment Policy,  Article 23 of the Universal Declaration of Human Rights. It also examines how the right to employment has been incorporated into successive Algerian constitutions, especially the 2020 Constitution, which emerged in a tense political context following the popular Hirak movement and states in Article 66 that "Work is a right and a duty; every work deserves remuneration." The study’s key distinction lies in its effort to connect constitutional provisions with Algeria’s international obligations, highlighting areas of alignment and discrepancy. The core conclusion reached is that recognizing the right to employment is not sufficient unless it is supported by clear legal texts and judicial and legislative mechanisms that activate and protect it—preventing it from becoming a mere political slogan.
