| dc.description.abstract | نظرا للأهمية الكبيرة التي تحتلها العلامة التجارية من بين عناصر الملكية الصناعية والتجارية، لاسيما بعد التطور الكبير الذي شهدته التجارة، وظهور مجالات أخرى أصبح استخدام العلامة فيها ضروريا كمجال تقديم الخدمات، اهتمت مختلف الاتفاقيات الدولية والتشريعات المقارنة، وال رسات الفقهية بإيجاد تعريف لها يساير التطور الذي عرفته، فلم تعد العلامة تتخذ الشكل التقليدي بل أصبحت تأخذ صورا وأشكالا مختلفة تضاف إلى الأشكال المتعارف عليها وتكمن أهمية العلامة التجارية في اعتبارها ضمان للجودة وأداة للدعاية والإعلان لفائدة مالكه من خلال دراساستنا تختلف العلامة التجارية كونها عنصر من عناصر الملكية الفكرية لعامة والملكية الصناعية الخاصة واشارة مميزة للسلع والخدمان عن بعضها البعض ان المشرع الجزائري اعطى اهمية كبيرة للعلامات من خلال سن قواعد قانونية خاصة.
