| dc.description.abstract | يتناول موضوع بحثنا هذا النظام القانوني للأمين العام للبلدية والدور الهام الذي يلعبه في تسييرها من خلال المهام والصلاحيات المخولة له واشكالية تجسيده لمبدأ اللامركزية الإدارية. وتعد البلدية القاعدة اللامركزية في التنظيم الإداري. وعليه فقد كان الهدف من دراستنا هو تسليط الضوء على إحدى هيئاتها ممثلة في منصب الأمين العام للبلدية، من خلال معالجة الأطر القانونية والتنظيمية التي ساهمت في تطويره، وتقديم دراسة واقعية عن طبيعة مهامه وصلاحياته التي أصبحت تضاهي صلاحيات رئيس المجلس الشعبي البلدي بل وفي كثير من الأحيان تتداخل معها، وكذا طرق تعيينه التي أصبحت مركزية سواء كانت مباشرة أو غير مباشرة، وبذلك أصبح الأمين العام للبلدية يمثل هيئة عدم تركيز إداري على مستوى الإدارة المحلية اللامركزية. Abstract: The topic of our research deals with the legal system of the Municipality General Secretary and his important role in it' s management through his tasks and prerogatives and the problem of the principle of administrative decentralization embodiment. The Municipality is considered as the decentralized base at the administrative organization, therefore ,the aim of our study is to shed light on one of it' s organs represented in the Municipality’s General Secretary, by addressing the legal and regulatory frameworks that contributed to its development, and provide a realistic study on his duties and prerogatives nature, which have become comparable to of the President of the Municipal People's Council's prerogatives, which can interfere with them in many cases, even it's appointment methods have become central whether direct, thus, the General Secretary of the Municipality has become an administrative deconcentration body at the level of decentralized local administration | en_US |
