| dc.description.abstract | جاءت هذه الدّراسة بعنوان (( جريمة الاعتداء على الأموال العامة ))، وكانت أهدافُها الرئيسية محاولةُ التّعرُّفِ على ماهيةِ جريمة الاعتداءِ على الأموال العمومية، ونظرةِ المشرّعِ الجزائري لهذه الجريمة؛ كما جاءت لتبيّنَ دورَ المشرِّعِ الجزائري في الحدِّ من هذه الجريمة والكشفِ عن أهمِّ الآلياتِ التي وضَعها المشرِّعُ الجزائري للحدِّ من جريمةِ تبديدِ الأموالِ العمومية، وكذا العقوباتِ المقرَّرةِ لهذهِ الجريمة على النّطاقين، المحلّي والدّولي. وقد استخدمنا المنهج التحليلي الوصفي باعتباره الأنسب والذي سوف يظهر من خلال حصر لبعض النصوص المتعلقة بجريمة تبديد الأموال من نظر المشرع الجزائري وشرح مضمونها، وقد تطرقنا في الإطار النظري للدراسة إلى فصلين هما: الفصل الاول: الاطار النظري لجريمة الاعتداء والفصل الثاني: الحماية الجنائية للمال العام من جريمة الاعتداء، وخرجنا بنتائج أهمُّها: - المال العام هو المال المرصود للنفع العام، أي المخصص لتمكين المرفق العام من القيام بدوره في إشباع الحاجيات العامة للمجتمع، أو توفير خدمة عامة، أو تحقيق إيراد للدولة، سواء كان هذا المال منقولا أو غير منقول. - كما أولى المشرع الجزائري في إطار التدابير الوقائية الموضوعية لحماية المال العام من جريمة الاختلاس أهمية كبيرة فيما يتعلق بالعنصر البشري، الذي يعتبر الركيزة الأساسية المكملة العنصر المال العام. - ومن بين أهم الأجهزة الوقائية التي أنشأها المشرع الجزائري الهيئة الوطنية للوقاية من الفساد ومكافحته، والتي تعود أهميتها إلى المهام المنوطة بها، بكونها مركزا لجمع المعلومات واستغلالها، مما يساهم بشكل كبير في الكشف عن جرائم الفساد. الكلمات المفتاحية: جريمة الاعتداء؛ المال العام؛ المشرع الجزائري. Abstract This study came under the title of the crime of assaulting public funds, as it aimed to identify the nature of the crime of assaulting public funds and the Algerian legislator’s view of this crime. Public funds as well as the penalties prescribed for this crime at the local and international levels. We have used the descriptive analytical approach as the most appropriate, which will appear through an inventory of some texts related to the crime of wasting money from the perspective of the Algerian legislator and explain its content. From the crime of assault, we came out with the most important results: - Public money is money set aside for public benefit. That is, allocated to enable the public utility to play its role in satisfying the public needs of the community, providing a public service, or generating revenue for the state, whether this money is movable or immovable. - The Algerian legislator also attached great importance, within the framework of objective preventive measures to protect public money from the crime of embezzlement, with regard to the human element, which is the main complement to the element of public money. - Among the most important preventive devices established by the Algerian legislator is the National Authority for the Prevention and Combating of Corruption, which is important to the tasks entrusted to it, as it is a center for collecting and exploiting information, which contributes significantly to the detection of corruption crimes.
