| dc.description.abstract | تسعى هذه الدراسة إىل حتقيق جمموعة من األهداف نلخصها يف النقاط التالية، محاية مصلحة الطفل وتوفري بيئة صاحلة لنموه وتنميته السليمة، و حقيق املساواة بني الوالدين فيما يتعلق حبقوقهما وواجباهتما جتاه األطفال، ابإلضافة اىل توفري ا الستقرار والسالم األسري لألطفال الذين يعانون من منازعات احلضانة، و تنظيم اإلجراءات القانونية واإلجراءات القضائية املتعلقة بقضااي احلضانة لضمان العدالة والشفافية. كما خلصت الدراسة اىل حتديد األسس القانونية واإلجرائية املتعلقة ابحلضانة يف التشريع اجلزائري، و توضيح حقوق الطفل والوالدين يف قضااي احلضانة والتزامات كل طرف، بو أيضا حتديد املعايري اليت يستند إليها القضاة الختاذ قراراهتم يف قضااي احلضانة، ويف األخري حتليل التحدايت والصعوابت اليت تواجه األسر املنفصلة يف الوصول إىل اتفاق بشأن احلضانة. Abstract This study aims to achieve a set of objectives summarized in the following points: protecting the interests of the child and providing a conducive environment for their proper growth and development, ensuring equality between parents regarding their rights and responsibilities towards the children, in addition to providing stability and familial peace for children experiencing custody disputes, and organizing the legal and judicial procedures related to custody cases to ensure justice and transparency . The study also concluded by identifying the legal and procedural foundations related to custody in Algerian legislation, clarifying the rights of the child and the parents in custody matters, and the obligations of each party. It also identified the criteria on which judges rely to make their decisions in custody cases.
