Abstract
تعتبر مسألة حماية البیئة قضية محلية إقليمية أكثر منها قضية مركزية وذلك لقرب الهیئات المحلية من الواقع وخصوصيات البیئة التي تتمیز بها، حیث منح المشرع الجزائر للجماعات الاقليمية استقلالية تامة في إعداد التهیئة العمرانية المحلية ونجد الأساس القانوني في المخططات التعمیر في قانون التهیئة والتعمیر وقانون البلدية فقد نصت المادة 113 من القانون 11/10 المتعلق بالبلدية على أن تتزود البلدية بكل أدوات التعمیر المنصوص عنها في التشريع والتنظيم المعمول بها بعد المصادقة علیها والتي تندرج طبيعيا ضمن سلطاتها واختصاصاتها حیث ظهر الدور المزدوج ذو الهدف المشترك للجماعات الاقليمية من خلال تكليفها قانونا بإعداد مخططات التعمیر آخذا الانشغالات البیئية في الحسبان كما ألزم قانون البلدية رئيس مجلس الشعبي البلدي طبقا لنص المادة 94 منه باحترام تعلبمات المحيط وحماية البیئة.
فإذا كانت أدوات التهیئة والتعمیر تسعى إلى عقلنة استعمال المجال وطرفيه التوسع العمراني الحضري فالمشرع أوجب علیها إدراج البعد البیئي في مضمونها وفي الإجراءات المتبعة عند إعدادها.
Abstract :
Environmental protection is more a regional domestic issue than a central one, because local bodies are close to the reality and specificity of their environment. The Algerian legislature granted the regional communities complete independence in preparing local urban planning and found the legal basis for reconstruction plans in the Law on Reconstruction and Development and the Municipal Code. Article 113 of Law 11/10 on the Municipality provided that the municipality would be provided with all the reconstruction tools provided for in the legislation and organization in force after ratification It is the natural part of its powers and competence, reflecting the dual role of the regional groups with a common objective by legally charged with preparing reconstruction plans taking into account environmental concerns
The Municipal Code also required the Speaker of the Municipal People's Assembly, in accordance with article 94 of the Act, to respect the ocean's instructions and protect the environment. If the instruments of adaptation and reconstruction seek to rationalize the use of the field and its pathway to urban urbanization, the legislature must incorporate the environmental dimension into its content and in the procedures followed in its preparation.
