Abstract
يعد عقد الزواج من العقود الرضائية، والذي عرف الكثير من العناية والاهتمام سواء من قبل الفقه الإسلامي أو قانون الاسرة الجزائري، ولقد اعترف هاذين الأخيرين بحق الاشتراط في عقد الزواج لكلا الزوجين، ويجوز لهما أن يشترطا ما يريدانه من الشروط لكن هذا الحق غير مطلق لوجود قيود وضوابط تحد من حرية الطرفين .

Summary :
