| dc.description.abstract | من خلال الموضوع محل الدراسة يتبين لنا إن إنشاء التوقيع الالكتروني والاعتراف بمدى حجيته في الاثبات يتطلب القيام بعدة إجراءات, تبدأ بصدوره عبر الانترنت والوسائط التكنولوجية في شكل بيانات إلكترونية متخذا صورا مختلفة بحسب الطريقة التي اصدر بها , معتمدا في ذلك تكنولوجيا التشفير والترقيم, وحتى ينتج حجيته القانونية يجب أن يكون موثقا وينشأ وفق شروط ومعايير معينة فيصدر بواسطة وسائل خاصة بالموقع وخاضعة لسيطرته وان يرتبط التوقيع بالبيانات المحرر الالكتروني’ كما يتعين ان يعرف بهوية صاحبه وان يعبر عن رضاه بمحتوى المحرر الالكتروني, كما إن هذا لاينفي الحجية على التوقيع الالكتروني التي لم تتوفر فيه هاته العناصر شرط ان تثبت كفاءة منظومة إنشاء هذا التوقيع. الكلمات المفتاحية: التوقيع التقليدي -التوقيع الإلكتروني- التشفير- الوسائط التكنولوجية- الانترنت- المحرر الالكتروني. Summary: Through the subject matter under consideration, we find that the creation of an electronic signature and the recognition of its authenticity in proof requires several actions. It begins with its release via the Internet and technological media in the form of electronic data taking different images depending on the way it is issued, In order to produce its legal authenticity, encryption and numbering technology must be documented and established in accordance with certain conditions and criteria. It shall be issued by means specific to the site and subject to its control. The signature shall be linked to the electronic editor's data. " Nor does this negate the authenticity of an electronic signature, which does not meet these elements, provided that the effectiveness of the signature's establishment system is demonstrated. | en_US |
