| dc.description.abstract | تجمع هذه الصفحات صورة موجزة على النظام القضائي الإسلامي، بداية من التعاريف الأولية التي اصطلح عليها فقهاء القضاء، إلى تجلية كل ما هو مقرر من المسائل والقضايا الفقهية في فقه القضاء الإسلامي، وعرفنا من خلالها ما يبنى عليه من الدقة والإحكام، وما حواه من جليل القضايا التي يسمو بها الفقه كعلم وتنتظم به دنيا الناس كواقع معاش، إذ القضاء الإسلامي يهتم بالحال والمآل، حيث يراعى في اختيار القائمينعلى شأنه شروطا للتولية، ويزيد وضوحا واعتدالا ببيان حدود العمل والتقليد عمومه وخصوصه، ويرفع من شأن المباشرين له والمنفذين لأحكامه فيمنحهم حصانة واستقلالية تامة، بها تتحقق مقاصد القضاء في دنيا الناس، وينتظم حال المجتمع عزيزا بعدالة القضاء وإنصاف قضاته، وقد حكمت هذه الشريعة في زمن مضى فكانت أزهى العصور وأعلاها نظاما ورتابة، مما جعلها الفترة المثالية والمرحلة القدوة في تاريخ الأمة الإسلامية وربما للبشرية جمعاء. الكلمات المفتاحية: القضاء، العدالة، الفقه الإسلامي، مقاصد القضاء، القاضي.
