Abstract
يتوقف تحديد نطاق عقود الاستهلاك وطبيعة الشروط التي تتضمنها على صفة أطراف العلاقة التعاقدية وما يتميز به كل طرف من ضعف وحاجة أو قوة ونفوذ ما يجعلها تتصف بعدم التوازن العقدي الذي استفحل خاصة مع ظهور الحركة الصناعية وتنوع السوق بين العادية والالكترونية وضرورة السرعة في إبرام الصفقات ما ساهم في بروز العقود النموذجية المحررة مسبقا من الطرف المسيطر على العقد بشروط تعسفية تثقل كاهل المتعاقد الضعيف وهو ما استوجب ضرورة التدخل لحمايته من مثل هذه التعاقدات لذا جاء المشرع بعدة آليات غير أن هذه الحماية لا تتحقق إلا إذا اقترنت بالجزاء.

The determination of the consumptive contracts domain and the nature of conditions that are included in relies on the manner of the contractors and on what each side of the contract is caracterized by from power and need to weakness and to influence so that it created the non balance of the contract which has been exacerbated espacially within the appearance of the industrial movement and the diversity of the market between ordinary and electronic and the necessity of speed in making deals which contributed to the spread of the typical contracts pre-edited by the dominating side with abusive conditions which harm the weak side of the two contactors, therefor we should interfere to protect him against such contracts and that is why the legislator enacted a lot of means but this protection is not achieved unless there is penalty.
