| dc.description.abstract | يعتبر الحدي ث عن السر المهني بصفة عامة من أ ُ بشدة و إلحاح، و الذي ال يطلع عليه إال بعض الثقاة الذين حددهم القانون سلفا و المتمثلين غيرهم. مناء السر المهني من قضاة و محامون و خبراء و في أ و تتناول هذه الدراسة السر المهني في قضايا شؤون األسرة ماهيته، والمسؤولية المترتبة على إفشاءه فضال عن االستثناءات التي أجاز فيها المشرع خرق ذلك االلتزام. حيث يتجلى لنا من خاللها ب أن المشرع قد ألزم أمناء السر المهني في قضايا شؤون األسرة بضرورة االلتزام بكتمانه مرتبا عليهم في حالة اإلخالل بذلك االلتزام مسؤوليتهم الجزائية، المدنية ، و حتى الت أديبية ، إال في الحاالت التي أجاز فيها لهم إفشاء ذلك السر في الحدود الضيقة لحماية المصلحة العامة أو الخاصة. الكلمات المفتاحية: السر المهني، قضايا شؤون األسرة، المؤتمن على السر، صاحب السر، اإلفشاء، الكتمان. 96 summary Talking about professional secret in general is considered one of the most prominent issues that have been raised with great urgency, and which is known only to some of the trustworthy people who were previously defined by law, represented by professional secretaries such us judges, lawyers, experts and others. This study deals with the nature of the professional secret in family affairs issues, and the responsibility resulting from its disclosure, as well as the exceptions in which the legislator permitted the breach of that obligation, as it is clear to us through them that the legislator has obligated professional secretaries in family affairs issues the necessity of keeping the secret, and if they breach that obligation, they will be liable to penal, civil and even disciplinary responsibility, except in cases in which it is permitted for them to disclose that secret within the narrow limits that seek to protect the public or private interest.
