dc.description.abstractPublic procurement contracts are among the most important administrative contracts used in public administration transactions, given the high costs borne by the public treasury in various fields, Because this period played an effective role in achieving economic development for the country. This development was only possible through Marakian Joy, who contributed to the achievements, Because these deals play an effective role in achieving economic development in the country, this development can only be achieved by respecting a fundamental principle: competition in the public procurement process, This is the cornerstone of the success of public demand, as well as the rationalization of public spending. The Algerian legislator has worked to enshrine this principle through a variety of mechanisms, including legal, administrative, and judicial ones, It has been incorporated as a general principle through clear legal procedures and texts regulating public procurement. The absence of this principle in the process of concluding a public procurement constitutes an environment conducive to the spread of corruption, a deviation from the principle of legality, and a failure to enable the administration to perform its duties as required.
