Abstract
جريمة الاختطاف من اخطر الج ا رئم الواقعة على الطفل ,لأنها تشكل اعتداءا صارخا على كافة حقوقه
والتي من أهمها حقه في الحرية والحياة الذي لا ينبغي التعدي عليه باي شكل من الاشكال .
وجريمة اختطاف الأطفال في الغالب لا تقتصر على الابعاد والاخذ فحسب وانما تمتد لتشمل ج ا رئم أخرى
تكون لها صلة وثيقة بجريمة اختطاف الأطفال ,فهذه الأخيرة من الج ا رئم المركبة والجسيمة التي تعتمد على
مجموعة من الأفعال التي يشكل كل منها جريمة بحد ذاته كالاغتصاب ,او طلب فدية والابت ا زز ,او المتاجرة
بهم وغيرها من الج ا رئم التي تعد الدافع الرئيسي لارتكابها ,
وجريمة اختطاف الأطفال كباقي الج ا رئم تقوم على مجموعة من الأركان حتى تصبح تامة وقد تتوقف في حد
الشروع. كما وجدنا ان هذه الأخيرة تكون بصور مختلفة, فقد تكون على طفل حديث العهد بالولادة او على
طفل اقل من ثمانية عشر ) 18 ( سنة وأيضا تكون باستخدام العنف والقوة والتهديد او بدونه ,
وحتى نتمكن من مواجهة هذه الجريمة لا بد من الوقاية منها وتجنب وقوعها أصلا , لان الوقاية تكون
دائما خير من العلاج , وذلك من خلال تضافر جهود مختلف المؤسسات والهيئات في الدولة, وتوفير
الحماية والامن على المستوى الداخلي والخارجي .
ونظ ا ر للخطورة الكبيرة التي تشكلها هذه الجريمة اصدر المشرع الج ا زئري قانون خاص بالوقاية من ج ا رئم
اختطاف الأشخاص ومكافحتها وهو القانون 20 / 15 ,اهم ما تضمنه هو الج ا زء المقرر لجنايات خطف
الأشخاص سواء البالغين او الأطفال. حيث نص على هذا الفعل بعقوبة السجن , وعاقب على محاولة
الشروع فيه ,كما انه وضع امام الجاني طريقة للعدول فأفاده بأعذار مخففة وربطها بشروط معينة . لأنه لا
شك منه ان تجريم هذه الأفعال والنص بالعقاب عليها يؤدي الى تحقيق الردع العام وذلك لما يكون للعقوبة
من اثر ا زجر في نفوس بعض من تحدثهم انفسهم بارتكاب مثل هذه الج ا رئم ويستهينون بالوقوع فيها لإشباع
رغباتهم .
ولعل خير ما اختتم به هذه المذكرة هو ان أقول ان أطفالنا فلذات اكبادنا تمشي على الأرض لا حياة ولا
هناء ولا سعادة لنا ,ولا حاضر ولا مستقبل دونهم لهم الحق في العيش الكريم ,وفي الرعاية الصحية والنفسية
والتعليم والعب والحنان ,لكن قبل كل هذه الحقوق لهم الحق في الحماية التي على الاسرة أولا توفيرها ,فان
غابت حماية الاسرة فان الطفل يصبح لقمة سهلة في افواه بعض المتوحشين المنتشرين وسط المجتمع ,كما
انه ان غاب دورها أيضا يصنع المنحرفين .

The crime of kidnapping is one of the most serious crimes against a child, because it constitutes a flagrant attack on all his rights, the most important of which is his right to freedom and life, which should not be infringed in any way.
And the crime of kidnapping children in most cases is not limited to deportation and taking only, but extends to include other crimes that are closely related to the crime of child kidnapping, the latter of the complex and serious crimes that depend on a group of acts, each of which constitutes a crime in itself, such as rape, ransom demand and extortion, or trafficking in them and other crimes that are the main motive for their commission,
The crime of kidnapping children, like other crimes, is based on a set of pillars until it becomes complete and may stop at the point of attempt. We also found that the latter is in different ways, it may be on a newborn child or on a child under eighteen (18) years old, and also using violence, force and threats or without it,
In order to be able to confront this crime, it must be prevented and avoided in the first place, because prevention is always better than treatment, through the concerted efforts of the various institutions and bodies in the state, and the provision of protection and security at the internal and external levels.
In view of the great danger posed by this crime, the Algerian legislator issued a law on the prevention and control of the crimes of kidnapping of persons, which is Law 20/15. The most important of its contents is the penalty prescribed for the felonies of kidnapping persons, whether adults or children. Where he stipulated this act with a prison sentence, and punished the attempt to attempt it, as he put in front of the offender a way of reversing, so he gave him mitigating excuses and linked them to certain conditions. Because there is no doubt that criminalizing these acts and stipulating punishment for them leads to achieving general deterrence, and that is because the punishment has a deterrent effect on the hearts of some of those whom they themselves talk about committing such crimes and they take it lightly to fall into it to satisfy their desires.
Perhaps the best conclusion of this memorandum is to say that our children, for their very own livers, walk on the earth. There is no life, no bliss, no happiness for us, no present and no future without them. They have the right to a decent life, health and psychological care, education, play and tenderness, but above all these rights are theirs. The right to protection that the family must first provide. If the family’s protection is absent, the child becomes an easy morsel in the mouths of some savages scattered among the society, and if its role is absent, it creates deviants.
