| dc.description.abstract | خص من خالل هذه الدراسة القانونية لموضوع من مواضيع القانون العام في مجال الوظيفة العمومية تناولنا بالدراسة والتحليل الوضعيات القانونية األساسية للموظف، التي اقرها األمر رقم 60-60 في المادة 107 منه، وهي وضعية القيام بالخدمة، وضعية االنتداب، وضعية خارج اإلطار، وضعية اإلحالة على االستيداع ووضعية اإلحالة على الخدمة الوطنية، و التي فصل في أحكامها المرسوم التنفيذي رقم 070-06، فبمجرد التحاق الموظف بإحدى اإلدارات العمومية، يمارس مهامه في وضعية لحاالت خالل مساره المهني، تقتضي منه تغيير سلكه و/أو ا نه قد تعتريه بعض الظروف و عادية، غير أ إدارته األصلية، أو تضطره إلى تقديم طلب التعليق المؤقت للعالقة الوظيفية، تندرج ضمن الوضعيات غير العادية، وتستلزم هذه الوضعيات من خالل تنوعها واآلثار المترتبة عنها، ضرورة التوفيق بين صالبة القواعد التي تحكم سير المصالح اإلدارية، والمرونة التي تبرر ها مقتضيات الحياة العادية للموظف. summary This study included within the subject of General law in the field of the public fonction, We got studied and analyzed the basic légal statuses of public fonctionner, approved by Ordinance No 06-03 in its article 027, namely : the position of activity, The placement on Availability, The Disqualification, National Service and Suspension of the functional relationship, the provisions of which have been detailed in Executive Decree No.20-373, Whereas, as soon as the employee joins a public administration, he exercises his duties and tasks in a normal position, except that he may encounter some circumstances and conditions during his professional path that require him to change his grade or original administration when he belong, or force him to submit a request for temporary suspension of the work relationship that falls within the exceptional situations, and these positions are required through Its diversity and its implications The need to reconcile the rigidity of the rules governing the functioning of administrative interests with the flexibility justified by the requirements of the normal life of a public employee. | en_US |
